I. GENERAL PROVISIONS

In the event that an individual provision in the program is regulated differently than in these general terms  and conditions, the provisions stated in the program shall apply. 

In the case of telephone sales or sales via the Internet, the passenger is deemed to have accepted the provisions of  these general terms and conditions when ordering the trip by telephone or via the Internet. The passenger can familiarize  himself with the provisions of the general terms and conditions on the website mataharinautics.com, where they are  specially marked and generally accessible. 

A subscriber or traveler is any person who has made a valid reservation or purchased or paid for a tourist package. 

These general terms and conditions do not apply to the purchase of airline tickets and the sale of tourist packages  organized by other providers, where MATAHARI acts as an intermediary. In this case, the passenger is bound by the  general terms and conditions of the organizer or airline and international legislation in this area. These general terms and  conditions also do not apply to health insurance with assistance abroad, where MATAHARI acts as an intermediary. In  this case, the general terms and conditions of the insurance company apply. 

II. APPLICATION AND CONTRACT 

The traveler can register for a tourist package organized by MATAHARI doo at MATAHARI or any authorized agency.  The travel program is considered an offer. Based on the offer, the traveler registers for the selected tourist package in  writing or orally. Upon registration, the traveler receives a MATAHARI document (invoice/travel confirmation), which  contains all information about the ordered tourist package and additional services, as well as the payment schedule and  any other agreements. 

The traveler is obliged to review the document and, in the event of any disagreement or error, to complain about it within  one day of its issuance. The traveler is obliged to provide the required information and submit the documents required by  the tourist package program upon registration, and to make the payment in accordance with the provisions of these  general terms and conditions. In the event that the traveler does not provide correct information upon registration, he is  responsible for all costs or consequences resulting from incorrect information. 

The passenger's registration is binding. He/she may withdraw from it in accordance with the provisions on the passenger's  cancellation of the trip. Any registration or order submitted verbally or in writing that contains the name and surname of  the passenger and other participants, the credit card number or identification of another payment instrument, payment or  partial payment of the price of the tourist package is considered a binding registration.

The above conditions do not apply to tourist packages organized by MATAHARI for so-called closed groups or for  tourist packages on request (individual offers). In this case, the travel program is considered an offer, and on the  basis of the offer, the traveler applies for the tourist package in writing by completing the application form, which  is specially prepared based on the conditions of the program, or by any other written confirmation. By completing  the application form or submitting the personal data of the travelers, the contract is considered concluded and, in  the event of a possible cancellation of the tourist package, the traveler is obliged to pay all costs in accordance  with the provisions on the traveler's cancellation of the trip. In accordance with the contract, MATAHARI is obliged  to provide the traveler with services that have the content and characteristics as announced in the contract or the  tourist package program, and to take care of the traveler's rights and interests in accordance with good business  practices. 

The passenger is obliged to ensure that he/she, his/her personal documents and his/her luggage meet the  conditions prescribed by border, customs, sanitary, monetary and other administrative regulations. MATAHARI  has the right to refuse the registration of a passenger who it can reasonably assume in advance does not meet  these conditions or would not meet them during the trip. 

III. APPLICATION FEE AND DEPOSIT 

MATAHARI charges the client for its services standard reservation costs and costs for compiling an offer for the  sale of tourist packages in accordance with the invitation to tender for each reservation. MATAHARI may set  different reservation costs for an individual tourist package. If the traveler does not accept the offer, the deposit is  not returned. 

IV. PAYMENT 

The day of payment is considered the day when the traveler makes the payment directly to MATAHARI or an  authorized agency, or when MATAHARI receives the payment to the transaction account SI56 0400 0028 1686  292 (OTP banka dd). The traveler pays 50% or 100% of the trip price upon registration. 

The remaining amount (unless payment has already been made) must be paid by the traveler at least 10 days  before the start of the trip, unless otherwise specified in the MATAHARI document (contract, invoice). If the  traveler does not pay within the agreed deadline, this constitutes cancellation of the tourist package and the  provisions on cancellation of the tourist package by the traveler shall apply accordingly. 

The passenger undertakes to pay the difference that may arise due to a possible calculation error on the document  issued by MATAHARI, and MATAHARI undertakes to refund the passenger any overcharged amount resulting  from the calculation error. This obligation is valid until the end of the financial year. 

MATAHARI may stipulate in the program that the traveler pays for certain services that will be provided on site to  its representative ("mandatory surcharge on site"). V. PRICES 

The prices of the tourist package are determined by the program and are valid from the date of publication of the  program until changed. The price includes the services listed in the tourist package program. The price valid for  the traveler is the price on the day of conclusion of the contract or issuance of the invoice. 

In accordance with applicable law, MATAHARI may change this price even after the conclusion of the contract,  due to changes in the exchange rate or due to changes in the tariffs of carriers that affect the price of the tourist  package. In the event of a price change under this heading, MATAHARI shall notify the passenger or the  authorized travel agency that made the reservation in writing no later than 20 (twenty) days before departure and  shall issue an additional document (invoice), which the passenger is obliged to pay before departure. 

The price change due to exchange rate differences is calculated as the difference in the value of that part of the  costs that are expressed or calculated in a foreign currency, and is calculated at the exchange rate of (1) the  foreign currency on the day the tourist package is prepared (planned price according to the offer) and (2) on the  day the price change notice is prepared (usually 20-23 days before departure). The exchange rate of the Bank of  Slovenia is taken into account for the calculation. 

If the increase in the agreed price exceeds 8 percent of the price of the tourist package, the traveler may withdraw  from the contract without having to pay compensation. In this case, MATAHARI will refund the amount paid to the  traveler. 

MATAHARI also sets a starting price for a certain number of passengers in the tour package program, which may  be changed if a smaller number of passengers register for the trip. MATAHARI states this additional price in the  program in the form of a "mandatory surcharge in case of group size from/to persons". Upon registration,  MATAHARI charges the traveler the starting price of the trip. If the conditions for changing the price due to "smaller  groups" occur, the traveler cannot withdraw from the contract, as they were informed of them upon registration. 

VI. ARRANGEMENTS BY OTHER ORGANIZERS 

In the event that MATAHARI is not the organizer of the tourist package, it acts as an informant. In this case, it  provides the information received from the organizer of the tourist package to the traveler and assists him in  registering. The conditions of registration, payment and possible cancellation of the tourist package are in  accordance with the valid conditions of the travel organizer. The organizer of the tourist package is indicated on  the MATAHARI document. MATAHARI is considered to sell such tourist packages in

in a foreign name and for a foreign account. Any complaint is handled by the traveler with the tour operator,  and MATAHARI provides all necessary assistance. 

VII. SPECIAL SERVICES 

Special services are those services that are generally not included in the price of a tourist package (private  cabin, special meals, other optional extras, etc.) or for which additional charges are foreseen in the program  (visas, other additional charges, etc.), and therefore the passenger pays for them separately, unless  otherwise specified in the program. 

In the event that special services are offered for an individual tourist package, the traveler must indicate their  wishes for these services upon registration and pay for them in addition to the travel price. The published  prices for special services are valid only if these services are ordered and paid for upon registration for the trip. During the trip, the traveler pays for special services to the tour leader or MATAHARI representative in the  place where the service is provided, in the appropriate currency, if this service can still be ordered during the  trip, at the price valid on site. 

If the traveler registers for a travel package on their own, they can leave it to MATAHARI to try to find a  companion with whom they will share a room, or who is willing to share a room with them. Notwithstanding  the above, a traveler registered individually must pay an additional fee for a single room upon registration. In  the event that a companion is found for a traveler registered individually, the single room supplement will be  refunded to the traveler after the trip. In the event that two people register for a travel package and share a  room, and one of them cancels the travel package before the trip, the other traveler will bear the costs of the  single room supplement if another companion cannot be found. 

VIII. CANCELLATION INSURANCE 

If a traveler takes out travel cancellation insurance with an insurance company, the traveler's rights under  the cancellation insurance are exercised with that insurance company, and the general terms and conditions  of the insurance company apply. The course of resolving the claim and the time for resolving the claim are  within the jurisdiction of the insurance company with which the cancellation insurance is taken out. 

IX. PASSENGER'S CHANGE OF THE CONTRACT OR CANCELLATION OF THE TOURIST PACKAGE PACKAGE 

The passenger has the right to request a change to the contract (e.g. change of name, additional services,  change of accommodation, etc.) after its conclusion, and MATAHARI is obliged to check whether this is  possible. In the event of a change to the contract at the passenger's request, MATAHARI may charge the  passenger an administrative fee of EUR 21.00 for the change, unless otherwise specified in these general  terms and conditions. If the change results in additional costs (e.g. change of flight ticket), the passenger is  obliged to pay them.

The traveler has the right to cancel the tour package, either at the branch where he/she registered or directly  at the MATAHARI registration point. In the event that the traveler cancels the tour package, MATAHARI has  the right to a refund of the costs, which depend on the time remaining until the start of the trip. In any case,  MATAHARI requests a refund of the administrative costs of the reservation in the amount of EUR 21.00.  Unless otherwise specified in the program, the cancellation costs listed below apply: 

For tour packages: 

• cancellation up to 45 days before departure: 30% of the package price 

• cancellation from 44 to 30 days before departure: 50% of the package price 

• cancellation 29 to 22 days before departure: 80% of the package price 

• cancellation later than 21 days before departure: 100% of the package price 

For one-day tour packages: 

• cancellation up to 30 days before departure: 30% of the package price 

• cancellation from 29 to 22 days before departure: 50% of the package price 

• cancellation 21 to 15 days before departure: 80% of the package price 

• cancellation later than 14 days before departure: 100% of the package price 

The above does not apply to the rental of vessels or other things for which MATAHARI acts as an  intermediary. Their terms and conditions apply, not MATAHARI's terms and conditions. 

Notwithstanding the above cancellation costs, these may differ where required by the terms and conditions of  the travel arrangement, as determined by MATAHARI in accordance with the applicable terms and conditions  of sale and/or business partners. Cancellation costs may also differ where stated in the package tour program  or contract. 

When canceling a tour package before departure, the traveler must provide written cancellation or sign a  cancellation document issued by MATAHARI. If the traveler refuses to sign or confirm this document, it is  considered that the trip has not been canceled. 

During the trip, the traveler may terminate the tour package at his/her own request. If the traveler terminates  the tour package during the trip, he/she shall not be entitled to a refund of costs or purchase price, either in  part or in full, upon return. If the traveler changes the program at his/her own request during the trip or does  not travel according to the program that is an integral part of the contract with MATAHARI, the traveler shall be  deemed to have withdrawn from the contract during the trip. In this case, the traveler shall be liable for the  costs and damages caused by this. In the event of a change in the program at his/her own request or due to  force majeure, without there being any reasons on the part of MATAHARI due to improperly performed service,  the traveler shall not be entitled to claim any compensation or price reduction.

MATAHARI or an authorized person may refuse a passenger at any time before the trip or on the day of  departure if it assesses that the passenger could endanger the health or property of himself or others, or if he is  clearly under the influence of alcohol, drugs or other such substances at the time of departure. In such a case,  MATAHARI will act in accordance with the provisions on the passenger's cancellation. 

MATAHARI has the right to request the passenger to terminate the joint trip with the group during the trip if he/ she fails to ensure that he/she, his/her personal documents and his/her luggage meet the conditions set by  border, customs, sanitary, monetary and other regulations, or if he/she is clearly under the influence of alcohol,  drugs or other such substances, or if he/she behaves inappropriately towards other passengers and his/her  exclusion is requested by the group. In such a case, MATAHARI shall act in accordance with the provisions on  the passenger's cancellation. 

MATAHARI will claim all damage caused by the traveler during the duration of the tour package through his/her  inappropriate behavior. 

The amount of cancellation costs for a tourist package in the event that MATAHARI is not the tour operator is  determined by the general terms and conditions or another document of the organizer. 

X. CANCELLATION BY THE ORGANIZER 

In accordance with applicable law, MATAHARI reserves the right to cancel a tourist package if the minimum  required number of passengers specified in the program does not register for the tourist package. 

MATAHARI shall notify the passenger of the withdrawal from the contract if the minimum number of passengers has not  registered, no later than: 

• 20 days before the start of a tourist package lasting more than 6 days, 

• 7 days before the start of a tourist package lasting from 2 to 6 days, 

• 2 days (48 hours) before the start of a tour package lasting less than 2 days. 

In cases where MATAHARI explicitly guarantees departure in writing, it cannot cancel the tour package unless  fewer than the minimum number of passengers specified in the program register. 

MATAHARI reserves the right to withdraw from the contract in whole or in part if extraordinary circumstances  arise before or during the implementation of the program that could not have been anticipated, removed or  avoided and constitute a valid reason for MATAHARI not to conclude the contract if they had existed at the time  of conclusion of the contract. 

MATAHARI may terminate the contract or withdraw from the contract and demand compensation for damages from a  passenger who directly violates the provisions of the contract concluded with MATAHARI, especially if it is found that the  passenger intentionally provided incorrect information about the number of passengers or their age, or if changes  occurred during the trip and the passenger did not inform MATAHARI of this. 

MATAHARI reserves the right (and is not responsible) for changes to the date and time of departure or for  cancellations of the tour package due to changes in flight schedules or force majeure, and the right to change  the direction of travel if travel conditions change (new schedule, uncertain situation in the country where the  program is organized, natural disasters).

In the event that the situation on site does not allow MATAHARI to accommodate passengers in the ordered facility,  MATAHARI may accommodate the passenger in the same location in another facility of the same or higher category. 

XII. RESPONSIBILITY OF THE ORGANIZER 

MATAHARI is responsible for the fulfillment of the package travel contract regardless of whether the included  travel services are performed by it itself or by another company. 

The traveler shall, without undue delay, taking into account all the circumstances of the case, inform MATAHARI of any  non-conformities discovered during the performance of the travel services included in the package travel contract. 

If an individual travel service is not performed in accordance with the package travel contract, 

MATAHARI shall remedy the non-conformities unless: 

• this is not possible or 

• this gives rise to disproportionate costs, taking into account the extent of the lack of conformity and the value  of the travel services in which the lack of conformity with the contract occurs. 

If MATAHARI fails to remedy the non-conformity within a reasonable period specified by the traveler, the traveler may,  except in the cases referred to in the previous paragraph, remedy the non-conformity himself and request  reimbursement of the costs incurred. The traveler is not required to specify a reasonable period for remedying the non conformity if the non-conformity is of such a nature that it must be remedied immediately or if MATAHARI refuses to  remedy the non-conformity. 

If MATAHARI fails to remedy the non-conformity for the reasons stated in the previous paragraph, the passenger may request  a price reduction and compensation for damages in accordance with the provisions of Section XII of these General Terms and  Conditions. 

When MATAHARI determines after the start of the package tour that it cannot provide a significant part of the travel  services as agreed in the package tour contract, including the return, it shall offer the traveler, without paying any  additional costs for the further implementation of the package tour, appropriate alternative travel services, which are  possibly of the same or higher quality than those agreed.

Where the proposed alternative travel services result in a travel package of lower quality than stated in the  package travel contract, MATAHARI shall reduce the price of the travel package accordingly. 

The traveler may only reject the proposed alternative travel services if they are not comparable to those stated in  the package travel contract or if the price reduction is inadequate. 

If MATAHARI fails to remedy the non-conformities that significantly affect the performance of the tourist package within  a reasonable period of time set by the traveler, the traveler may withdraw from the package travel contract without  paying a cancellation fee and, in accordance with the provisions of Section XIV of these General Terms and Conditions,  request a price reduction or reimbursement of damages, where applicable. 

If MATAHARI is unable to provide suitable alternative travel services or if the passenger rejects the proposed  alternative services because they are not comparable to those specified in the package travel contract or the  price reduction is inadequate, the passenger may, where appropriate, request a price reduction or compensation in  accordance with point XIV of these general terms and conditions, even if he does not withdraw from the package  travel contract. 

If the tourist package also includes transport, in the cases referred to in the previous two paragraphs,  MATAHARI will also ensure a return trip by an equivalent means of transport without unnecessary delay and at no  additional cost to the passenger. 

If, due to unavoidable and extraordinary circumstances, it is not possible to ensure the return of the passenger as  agreed in the package travel contract, the costs of the necessary accommodation, preferably of an equivalent  category as agreed in the package travel contract, shall be covered by MATAHARI for a maximum of three nights. If  specific European Union regulations governing passenger rights stipulate a longer period applicable to the return  of the passenger by these means of transport, the longer periods shall apply in cases where these means of transport  are used. 

MATAHARI may not invoke unavoidable and extraordinary circumstances in limiting liability in accordance  with the previous paragraph if the carrier concerned is not permitted to invoke such circumstances under European  Union law. 

The cost limitation does not apply to persons with reduced mobility as defined in point (a) of Article 2 of Regulation  (EC) No. 1107/2006 of the European Parliament and of the Council of 5 July 2006 concerning the rights of disabled  persons and persons with reduced mobility when travelling by air (OJ L 204, 26.7.2006, p. 1), including accompanying  persons, pregnant women and unaccompanied minors, and persons in need of special medical assistance, provided  that MATAHARI has been informed of their special needs at least 48 hours before the start of the package. 

MATAHARI shall, without undue delay, offer appropriate assistance to a passenger who finds himself in difficulty  during his journey, including in the cases referred to in the previous three paragraphs. The assistance shall include in  particular: 

• providing relevant information about health services, local authorities and consular assistance; 

• assistance in providing means of distance communication; and 

• assistance in finding alternative travel arrangements.

If problems arise due to the intentional or negligent conduct of the passenger, MATAHARI may charge the passenger a  reasonable fee for the assistance provided in such a case, which may not exceed the actual costs. 

MATAHARI has arranged a guarantee with insurance from the insurance company GENERALI dd in case of liquidity  problems of the tour operator and the company that facilitates linked travel arrangements. 

XII. PASSENGER RIGHTS 

The traveler may request a proportional price reduction for each period during which there was a non-compliance of  the performed travel services with the package travel contract, unless MATAHARI proves that the traveler is  responsible for the non-compliance. 

The passenger has the right to have MATAHARI reimburse him without undue delay for any damage suffered by him due  to any lack of conformity with the contract, unless MATAHARI proves that: 

• the passenger is responsible for the non-compliance; 

• the lack of conformity is attributable to a third party not involved in the provision of the travel services included in  the package travel contract and the lack of conformity was unforeseeable or unavoidable; or 

• non-compliance resulting from unavoidable and extraordinary circumstances. 

The amount of monetary compensation for damage caused due to non-compliance with the contract is limited to three times  the total price of the tourist package, except for compensation for bodily injury and for damage caused intentionally or  through negligence. 

If international conventions binding the Republic of Slovenia limit the scope of compensation for damages or the  conditions under which the provider of individual travel services that are part of a tourist package is liable for compensation  for damages, these limitations apply to MATAHARI. 

The traveler may request a price reduction or compensation for damages due to non-conformity with the package  travel contract within two years of the occurrence of the non-conformity. 

Price reduction or compensation for non-compliance with the package travel contract does not affect the rights of  passengers under: 

• Regulation (EC) No. 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing  common rules on compensation and assistance to passengers in the event of denied boarding and of  

cancellation or long delay of flights, and repealing Regulation (EEC) No. 295/91 (OJ L 46 of 17. 2. 2004, p. 1),  last amended by the Corrigendum (OJ L 119 of 7. 5. 2019, p. 202); 

• Regulation (EC) No. 1371/2007 of the European Parliament and of the Council of 23 October 2007 on rail passengers'  rights and obligations (OJ L 315, 3. 12.

Passengers are entitled to file a claim in accordance with these general terms and conditions and the  aforementioned regulations and international conventions. 

Compensation or price reductions received by the passenger under these general terms and conditions and  regulations and international conventions are offset against each other to prevent overpayments. 

XIII. TRAVEL DOCUMENTS 

The traveler must have a valid passport or other valid document that allows them to enter the country to which or  through which they are traveling. 

The passenger is obliged to pay attention to all provisions regarding the validity of the travel document. The validity  of the document is considered on the last day of the trip. MATAHARI is not responsible for any inconvenience or  forced interruption of the passenger's trip in this regard. 

The traveler is obliged to obtain the visas required for these countries. If the traveler fails to fulfill this obligation,  MATAHARI will act in accordance with the provisions on the traveler's cancellation of the tour package. In the  event that MATAHARI arranges a visa for the traveler, it does not guarantee the success of obtaining the visa.  MATAHARI does not refund the costs of obtaining visas to the traveler. In the event of refusal of entry into the  country or other obstacles, the traveler bears all costs. 

The traveler is considered to be arranging the visa himself if MATAHARI does not deliver all the necessary documents  within the prescribed deadline, regardless of whether the traveler has already paid for the acquisition of these documents. 

Due to requirements in international passenger transport (air, ship, bus, etc.), the passenger is obliged to provide  all necessary information about all travel participants he/she is registering upon registration. The information must  fully match the information in the official documents that the travel participants are obliged to carry with them in  accordance with the regulations on crossing the state border and relevant foreign legislative acts.

In the event that incorrect information causes delays, additional costs or interruption of the trip for other  participants, the passenger is responsible for all costs incurred. 

If the passenger loses or has his documents stolen during the trip, and they are absolutely necessary for  the continuation of the trip or return to his homeland, the passenger shall obtain new documents at his own  expense. In the event that the passenger has to terminate the tourist package due to the loss or theft of  documents, he shall not be entitled to any refund of the paid tourist package or reimbursement of expenses. 

XIV. NOTICES 

The passenger will receive the final notification no later than 5 (five) days before departure. Any damage that may arise due to the  passenger providing an incomplete or incorrect address will be borne by the passenger. 

If the passenger does not receive the notification within the specified period, he/she is obliged to report to  his/her registration point and request it. MATAHARI will not consider complaints from unreceived mail. 

XV. HEALTH REGULATIONS 

The traveler is obliged to undergo the vaccinations required for the country of travel. If the travel program  lists or requires certain vaccinations, each traveler must obtain an international certificate - a yellow booklet  with a record of the vaccinations completed. 

MATAHARI is not responsible for any complications or the passenger's interruption of the tour package due  to the passenger's failure to comply with the health regulations of the country they are entering, nor for any  costs associated with this. 

XVI. CUSTOMS REGULATIONS 

The passenger is obliged to comply with all customs and foreign exchange regulations of the Republic of  Slovenia, as well as the regulations of all other countries to which and through which he travels. If the  passenger is unable to continue his journey due to non-compliance with the regulations, he bears all  consequences and costs arising in this regard for himself and all other passengers. 

XVII. LUGGAGE 

MATAHARI is not responsible for the transport, theft or damage of the passenger's luggage or other  personal belongings, valuables and documents from accommodation facilities (hotel rooms, apartments,  etc.) and means of transport (planes, buses, ships, etc.). The passenger himself/herself shall report lost or  damaged luggage to the carrier or hotel. 

The passenger must declare the transport of special luggage (such as a bicycle, surfboard, golf equipment,  skis, musical instruments, etc.) at check-in and pay the carrier in accordance with the carrier's rules, if

unless otherwise specified in the tourist package program. All costs or damage resulting from this shall be borne by  the traveler. 

During transportation, the passenger has the right to free transportation of a certain weight of luggage (according  to the carrier's regulations), and each additional kilogram is paid for by the passenger on site in the appropriate  currency or according to the carrier's regulations. Children under two years of age are not entitled to free  transportation of luggage.

XVIII. INFORMATION 

The information provided to the traveler at the registration point does not bind MATAHARI more than the statements  in the program or offer. In case of doubt, the written offer, invoice and travel contract, written information or written  explanation is always considered valid. 

XIX. COMPLAINTS 

The traveler is obliged to report irregularities to the MATAHARI representative on site when they occur. In the event  that the complaint could have been resolved on site (for example, insufficient cleanliness of the room, equipment,  location of the room, etc.), but the traveler did not report the error or irregularity to the agency representative, the  traveler is deemed to have agreed to such service and thereby lost the right to file subsequent complaints. 

The passenger may file a written complaint within two months from the date on which the service was incorrectly  provided, otherwise MATAHARI will not consider it in its entirety. The complaint must be substantiated. The  passenger should therefore attach to the complaint appropriate evidence and/or appropriate confirmation from the  hotelier, carrier or other appropriate person about the factual situation on the basis of which the passenger asserts  his claim. 

MATAHARI is obliged to respond to the complaint in writing within 8 days of its receipt. If it is a simple defect and  the defect is not disputed (or if the passenger has not attached all the necessary documents within the deadline  required to obtain them), MATAHARI is obliged to grant the request after receiving a complete complaint request. If  the defect is not simple, MATAHARI is obliged to investigate all the circumstances that led to the complaint. Until  MATAHARI decides on the complaint, the passenger waives the intervention of any other person, judicial institutions  or providing information to the public media. 

Regardless of the complaint filed, the passenger is obliged to settle his/her obligations under the issued invoices  for the service provided in accordance with the payment schedule; any compensation will be paid to the passenger's  personal account after the complaint procedure has been completed. 

XIX. OTHER PROVISIONS

7. The use of illegal substances is strictly prohibited at the event. The organizer is not responsible for any  illegal substances found on or off the vessel. 

The organizer is not responsible for the consequences of the use of alcohol and prohibited substances. In case of  non-compliance with this point, the procedure set out in point 6 of this statement will apply. 

8. The Organizer may, at its own discretion, use the services of external contractors. For their

XXI. FINAL PROVISIONS 

MATAHARI does not recognize any out-of-court consumer dispute resolution provider as competent to resolve  any dispute regarding the traveler's travel-related claims. In the event of a dispute between the parties, the  competent court shall apply.

I. SPLOŠNA DOLOČILA

Ti splošni pogoji so sestavni del pogodbe, ki jo skleneta podjetje MATAHARI d.o.o., Potarje 10, 4290 Tržič, e-pošta: sturm.bor@gmail.com, spletna stran: mataharinautics.com (v nadaljevanju: MATAHARI) oziroma v njegovem imenu pooblaščena oseba, in potnik, ki se prijavlja na turistični paket v organizaciji podjetja MATAHARI. V primeru, da je posamezna določba v programu urejena drugače kot v teh splošnih pogojih, veljajo določbe, navedene v programu.

V primeru telefonske prodaje oziroma prodaje preko interneta se šteje, da je potnik sprejel določila teh splošnih pogojev takrat, ko je telefonsko oziroma preko interneta naročil potovanje. Z določili splošnih pogojev se potnik lahko seznani na spletni strani mataharinautics.com, kjer so posebej označeni in splošno dostopni.

Naročnik oziroma potnik je vsaka oseba, ki je opravila veljavno rezervacijo ali opravila nakup oziroma plačilo turističnega paketa.

Ti splošni pogoji ne veljajo za nakupe letalskih vozovnic ter prodajo turističnih paketov v organizaciji drugih ponudnikov, kjer MATAHARI nastopa kot posrednik. V tem primeru potnika zavezujejo splošni pogoji organizatorja oziroma letalskega prevoznika ter mednarodna zakonodaja na tem področju. Ti splošni pogoji prav tako ne veljajo za zavarovanje zdravstvenega zavarovanja z asistenco v tujini, kjer MATAHARI nastopa kot posrednik. V tem primeru veljajo splošni pogoji zavarovalnice.

II. PRIJAVA IN POGODBA

Na turistični paket v organizaciji MATAHARI d.o.o. se potnik lahko prijavi v MATAHARI ali kateri koli pooblaščeni agenciji. Program potovanja velja kot ponudba. Na osnovi ponudbe se potnik pisno ali ustno prijavi na izbran turistični paket. Ob prijavi potnik prejme dokument MATAHARI (račun/potrdilo o potovanju), iz katerega so razvidni vsi podatki o naročenem turističnem paketu in dodatnih storitvah, kot tudi razpored plačil in morebitni ostali dogovori. Potnik je dolžan dokument pregledati in v primeru kakršnegakoli nesoglasja ali napake le-tega reklamirati v roku enega dneva po njegovi izdaji. Potnik je dolžan ob prijavi navesti zahtevane podatke in predložiti dokumente, ki jih zahteva program turističnega paketa, ter izvršiti plačilo v skladu z določbami teh splošnih pogojev. V primeru, da potnik ob prijavi ne navede pravilnih podatkov, je odgovoren za vse stroške oziroma posledice, nastale zaradi napačnih podatkov.

Prijava potnika je zavezujoča. Od nje lahko odstopi v skladu z določili o potnikovi odpovedi potovanja. Za zavezujočo prijavo se štejejo vsaka prijava ali naročilo, posredovano v ustni ali pisni obliki, ki vsebuje ime in priimek potnika in ostalih udeležencev, številko kreditne kartice ali identifikacijo drugega plačilnega inštrumenta, plačilo ali delno plačilo cene turističnega paketa ali drugo konkludentno dejanje, ki nakazuje, da je potnik posredoval zavezujočo prijavo.

Zgoraj navedeni pogoji ne veljajo za turistične pakete, ki jih organizira MATAHARI za t. i. zaključene skupine oziroma za turistične pakete po naročilu (individualne ponudbe). V tem primeru velja program potovanja kot ponudba, na osnovi ponudbe pa se potnik pisno prijavi na turistični paket z izpolnitvijo prijavnice, ki je posebej izdelana na osnovi pogojev iz programa, oziroma s kakršnokoli drugo pisno potrditvijo. Z izpolnitvijo prijavnice oziroma predložitvijo osebnih podatkov potnikov se šteje, da je pogodba sklenjena in je potnik ob morebitni odpovedi turističnega paketa dolžan poravnati vse stroške v skladu z določili o potnikovi odpovedi potovanja. MATAHARI je v skladu s pogodbo dolžna potniku nuditi storitve, ki imajo vsebino in lastnosti, kot so napovedane v pogodbi oziroma programu turističnega paketa, ter skrbeti za pravice in interese potnika v skladu z dobrimi poslovnimi običaji.

Potnik je dolžan skrbeti, da sam osebno, njegove osebne listine in njegova prtljaga izpolnjujejo pogoje, ki so predpisani z obmejnimi, carinskimi, sanitarnimi, denarnimi in drugimi upravnimi predpisi. MATAHARI ima pravico zavrniti prijavo potnika, za katerega lahko upravičeno vnaprej domneva, da teh pogojev ne izpolnjuje oziroma jih ne bi izpolnjeval tekom potovanja.

III. PRIJAVNINA IN VARŠČINA

MATAHARI za svoje storitve zaračunava naročniku standardne rezervacijske stroške in stroške za sestavo ponudbe pri prodaji turističnih paketov skladno z razpisom na vsako rezervacijo. MATAHARI lahko za posamezni turistični paket določi drugačne rezervacijske stroške. Če potnik ponudbe ne sprejme, se varščina ne vrača.


IV. PLAČILO

Za dan plačila se šteje dan, ko potnik izvrši vplačilo neposredno pri MATAHARI ali pooblaščeni agenciji, oziroma ko MATAHARI prejme plačilo na transakcijski račun SI56 0400 0028 1686 292 (OTP banka d.d.). Potnik ob prijavi plača 50 % ali 100% cene potovanja. Preostali del (razen če je plačilo bilo že izvedeno) potnik plača najmanj 10 dni pred začetkom potovanja, v kolikor ni na dokumentu MATAHARI (pogodba, račun) drugače določeno. Če potnik ne plača v dogovorjenem roku, to pomeni odpoved turističnega paketa in se smiselno uporabijo določila o potnikovi odpovedi turističnega paketa.

Potnik se obvezuje vplačati razliko, ki bi nastala zaradi morebitne računske napake na izdanem dokumentu MATAHARI, MATAHARI pa se obvezuje vrniti potniku eventualno preveč zaračunani znesek, ki izvira iz računske napake. Ta obveza velja do izteka poslovnega leta.

MATAHARI lahko v programu določi, da potnik plača določene storitve, ki bodo opravljene na kraju samem, njenemu predstavniku (»obvezno doplačilo na kraju samem«). V tem primeru MATAHARI ne nastopa kot organizator niti kot posrednik, ampak zgolj kot informator. Potnik v tem primeru uveljavlja vse reklamacijske zahtevke izključno od izvajalca storitve na kraju samem.

Kadar za potnika turistični paket rezervira pooblaščena turistična agencija, veljajo vsa določila iz te točke smiselno tudi za pooblaščeno turistično agencijo.

V primeru, da se stranka odloči za sklenitev zavarovanja turističnih potovanj pri izbrani zavarovalnici, nastane pogodbeno razmerje iz naslova zavarovanja s samim plačilom premije v prodajni enoti MATAHARI ali pooblaščeni agenciji oziroma ko je celotna zavarovalna premija plačana na transakcijski račun MATAHARI.



V. CENE

Cene turističnega paketa so določene s programom ter veljajo od dneva objave programa do spremembe. V ceno so vštete storitve, ki so navedene v programu turističnega paketa. Za potnika je veljavna cena na dan sklenitve pogodbe oziroma izdaje računa.

V skladu z veljavno zakonodajo lahko MATAHARI to ceno spremeni tudi po sklenitvi pogodbe, in sicer zaradi sprememb v menjalnem tečaju ali zaradi sprememb v tarifah prevoznikov, ki vplivajo na ceno turističnega paketa. V primeru spremembe cene iz tega naslova MATAHARI o tem najkasneje 20 (dvajset) dni pred odhodom pisno obvesti potnika oziroma pooblaščeno turistično agencijo, ki je naredila rezervacijo, ter izda dodatni dokument (račun), ki ga je potnik dolžan plačati pred odhodom.

Sprememba cene iz naslova tečajnih razlik se obračunava kot razlika vrednosti tistega dela stroškov, ki so izraženi oziroma obračunani v tuji valuti, in je obračunana po tečaju (1) tuje valute na dan priprave turističnega paketa (načrtovana cena po ponudbi) ter (2) na dan priprave obvestila o spremembi cene (običajno 20–23 dni pred odhodom). Za preračun se upošteva tečaj Banke Slovenije.

Če zvišanje dogovorjene cene preseže 8 odstotkov cene turističnega paketa, lahko potnik odstopi od pogodbe, ne da bi moral povrniti škodo. V tem primeru bo MATAHARI potniku vrnila vplačani znesek.

Prav tako MATAHARI v programu turističnega paketa določi izhodiščno ceno pri določenem številu potnikov, ki se lahko spremeni, v kolikor se za potovanje prijavi manjše število potnikov. MATAHARI v programu navede to dodatno ceno v obliki »obveznega doplačila v primeru velikosti skupine od/do oseb«. Ob prijavi MATAHARI potniku zaračuna izhodiščno ceno potovanja. V kolikor nastopijo pogoji za spremembo cene iz naslova »manjše skupine«, potnik ne more odstopiti od pogodbe, saj je bil z njimi seznanjen ob prijavi.


VI. ARANŽMAJI DRUGIH ORGANIZATORJEV

V primeru, da MATAHARI ni organizator turističnega paketa, nastopa v vlogi informatorja. V tem primeru podaja prejete informacije od organizatorja turističnega paketa potniku in mu pomaga pri prijavi. Pogoji prijave, plačila in morebitne odpovedi turističnega paketa so v skladu z veljavnimi pogoji organizatorja potovanja. Na dokumentu MATAHARI je naveden organizator turističnega paketa. Šteje se, da MATAHARI prodaja tovrstne turistične pakete v tujem imenu in za tuj račun. Morebitno reklamacijo ureja potnik z organizatorjem potovanja, MATAHARI pa mu ob tem nudi vso potrebno pomoč.


VII. POSEBNE STORITVE

Posebne storitve so tiste storitve, ki praviloma niso vštete v ceno turističnega paketa (zasebna kabina, posebna prehrana, druga doplačila po želji ...) ali pa so za njih v programu predvidena doplačila (vizumi, druga doplačila ipd.), zato jih potnik plača posebej, razen če ni v programu drugače določeno.

V primeru, da so k posameznemu turističnemu paketu razpisane posebne storitve, potnik posreduje želje po teh storitvah ob prijavi, doplača pa jih k ceni potovanja. Objavljene cene posebnih storitev veljajo zgolj v primeru naročila in plačila teh storitev ob prijavi na potovanje. Med potovanjem potnik doplača posebne storitve vodji potovanja ali predstavniku MATAHARI v kraju, kjer se storitev opravlja, v ustrezni valuti, če je med potovanjem to storitev še mogoče naročiti, po ceni, veljavni na kraju samem.

Če se potnik sam prijavi na turistični paket, lahko prepusti MATAHARI, da se mu potrudi najti sopotnika, s katerim bo delil sobo, oziroma ki je pripravljen z njim deliti sobo. Ne glede na omenjeno pa mora posamezno prijavljeni potnik ob prijavi doplačati za enoposteljno sobo. V primeru, da se posamezno prijavljenemu potniku najde sopotnik, se potniku po potovanju vrne doplačilo za enoposteljno sobo. V primeru, da se na turistični paket prijavita dva, ki sta skupaj v sobi, pred potovanjem pa eden od njiju turistični paket odpove, drugi potnik nosi stroške doplačila za enoposteljno sobo, če mu ni možno najti drugega sopotnika.

VIII. ZAVAROVANJE ODPOVEDI

V primeru, da potnik sklene zavarovanje rizika odpovedi turističnega potovanja pri kateri izmed zavarovalnic, se potnikove pravice iz naslova zavarovanja rizika odpovedi uveljavljajo pri tej zavarovalnici, pri čemer se uporabljajo splošni pogoji zavarovalnice. Potek reševanja škodnega primera in čas reševanja škodnega primera sta v pristojnosti zavarovalnice, pri kateri je sklenjeno zavarovanje rizika odpovedi.


IX. POTNIKOVA SPREMEMBA POGODBE ALI ODPOVED TURISTIČNEGA PAKETA

Potnik ima pravico zahtevati spremembo pogodbe (npr. sprememba imena, dodatne storitve, sprememba namestitve ipd.) po njeni sklenitvi, MATAHARI pa je dolžna preveriti, ali je to mogoče. V primeru spremembe pogodbe na zahtevo potnika lahko MATAHARI zaračuna potniku administrativne stroške v višini 21,00 EUR za spremembo, če ni s temi splošnimi pogoji drugače določeno. V primeru, da s spremembo nastanejo dodatni stroški (npr. sprememba letalske karte), jih je potnik dolžan poravnati.

Potnik ima pravico do odpovedi turističnega paketa, in sicer v poslovalnici, kjer se je prijavil, ali direktno na prijavnem mestu MATAHARI. V primeru, ko potnik odpove turistični paket, ima MATAHARI pravico do povračila stroškov, ki so odvisni od časa, ki je ostal do začetka potovanja. V vsakem primeru MATAHARI zahteva povrnitev administrativnih stroškov rezervacije v višini 21,00 EUR. Če na programu ni drugače določeno, veljajo spodaj navedeni odpovedni stroški:

Za turistične pakete:

  • odpoved do 45 dni pred odhodom: 30 % cene aranžmaja

  • odpoved od 44 do 30 dni pred odhodom: 50 % cene aranžmaja

  • odpoved 29 do 22 dni pred odhodom: 80 % cene aranžmaja

  • odpoved kasneje kot 21 dni pred odhodom: 100 % cene aranžmaja

Za enodnevne turistične pakete:

  • odpoved do 30 dni pred odhodom: 30 % cene aranžmaja

  • odpoved od 29 do 22 dni pred odhodom: 50 % cene aranžmaja

  • odpoved 21 do 15 dni pred odhodom: 80 % cene aranžmaja

  • odpoved kasneje kot 14 dni pred odhodom: 100 % cene aranžmaja


Zgoraj omenjeno ne velja za najem plovil ali drugih stvari, pri katerih MATAHARI velja kot posrednik. Pri temo veljajo njihovi pogoji poslovanja in ne pogoji poslovanja MATAHARI.

Ne glede na zgoraj določene stroške odpovedi so ti lahko drugačni, kadar to narekujejo pogoji organiziranja potovanja, ki jih MATAHARI določa skladno z veljavnimi pogoji prodaje in/ali poslovnimi partnerji. Prav tako so stroški odpovedi lahko drugačni, če so navedeni v programu turističnega paketa ali pogodbi.

Ob odpovedi turističnega paketa pred odhodom potnik poda pisno odpoved oziroma podpiše odpovedni dokument, ki ga izda MATAHARI. Če potnik zavrne podpis ali potrditev tega dokumenta, se šteje, da potovanja ni odpovedal.

Med potovanjem lahko potnik prekine turistični paket na svojo željo. Če potnik med potovanjem turistični paket prekine, ob vrnitvi nima pravice do povračila stroškov ali kupnine, ne delno ne v celoti. V kolikor potnik med potovanjem po svoji želji spremeni program oziroma ne potuje po programu, ki je sestavni del pogodbe z MATAHARI, se šteje, da je potnik odstopil od pogodbe med potovanjem. V tem primeru je potnik odgovoren za stroške in škodo, ki jih je s tem povzročil. V primeru spremembe programa na lastno željo ali zaradi višje sile, ne da bi obstajali razlogi na strani MATAHARI zaradi nepravilno opravljene storitve, potnik nima pravice zahtevati kakršnekoli odškodnine ali znižanja cene.

MATAHARI oziroma pooblaščena oseba lahko kadar koli pred potovanjem ali na dan odhoda zavrne potnika, kadar oceni, da bi lahko ogrozil zdravje ali premoženje sebe ali drugih, oziroma če je ob odhodu očitno pod vplivom alkohola, drog ali drugih tovrstnih substanc. V tem primeru MATAHARI ravna po določilih o potnikovi odpovedi.

MATAHARI ima pravico med potovanjem zahtevati od potnika, da prekine skupno pot s skupino, če ne poskrbi za to, da sam osebno, njegove osebne listine in njegova prtljaga izpolnjujejo pogoje, ki jih določajo obmejni, carinski, sanitarni, denarni in drugi predpisi, ali če je očitno pod vplivom alkohola, drog ali drugih tovrstnih substanc, ali če se neprimerno obnaša do ostalih sopotnikov in njegovo izločitev zahteva skupina. V tem primeru MATAHARI ravna po določilih o potnikovi odpovedi.

MATAHARI bo uveljavljala vso škodo, ki bi jo potnik povzročil med trajanjem turističnega paketa s svojim neustreznim ravnanjem.

Višina stroškov odpovedi turističnega paketa v primeru, da MATAHARI ni organizator potovanja, je določena s splošnimi pogoji ali drugim aktom organizatorja.

X. ODPOVED S STRANI ORGANIZATORJA

MATAHARI si v skladu z veljavno zakonodajo pridržuje pravico do odpovedi turističnega paketa, če se na turistični paket ne prijavi minimalno potrebno število potnikov, ki je navedeno v programu.
MATAHARI potnika obvesti o odstopu pogodbe, če se ni prijavilo minimalno število potnikov, najkasneje:

  • 20 dni pred začetkom turističnega paketa, ki traja več kot 6 dni,

  • 7 dni pred začetkom turističnega paketa, ki traja od 2 do 6 dni,

  • 2 dni (48 ur) pred začetkom turističnega paketa, ki traja manj kot 2 dni.

V primerih, ko MATAHARI izrecno pisno jamči odhod, ne more odpovedati turističnega paketa, razen če se prijavi manj kot v programu predvideno najmanjše število potnikov.

MATAHARI si pridržuje pravico do popolnega ali delnega odstopa od pogodbe, če pred izvajanjem ali med izvajanjem programa nastopijo izredne okoliščine, ki jih ni bilo mogoče pričakovati, odstraniti ali se jim izogniti, in za MATAHARI pomenijo utemeljen razlog, da pogodbe ne bi sklenila, če bi obstajale ob sklenitvi pogodbe.

MATAHARI lahko odpove pogodbo oziroma odstopi od pogodbe in zahteva povrnitev škode od potnika, ki neposredno krši določbe pogodbe, ki jo je sklenil z MATAHARI, predvsem če se ugotovi, da je potnik namerno sporočil napačne podatke o številu potnikov ali njihovi starosti, oziroma če je med potovanjem prišlo do sprememb, potnik pa o tem ni obvestil MATAHARI.

MATAHARI si pridržuje pravico (in ne odgovarja) za spremembe dneva in časa odhoda oziroma za odpovedi turističnega paketa zaradi spremembe letalskega voznega reda ali nastopa višje sile ter pravico do spremembe smeri potovanja, če se spremenijo pogoji za potovanje (nov vozni red, negotov položaj v državi, kjer je organiziran program, naravne nesreče ali drugi nepredvideni vzroki, na katere MATAHARI ne more vplivati), brez posebne odškodnine in po veljavnih predpisih v potniškem prometu.

Odgovornost MATAHARI je omejena zgolj na neizvedbo določenega dela programa, v delu, ki pomeni ustrezne materialne stroške. MATAHARI ne odgovarja za škodo, ki bi nastala iz naslova zamud, odpovedi ali spremembe prevoza ali prevoznega sredstva.

V primeru, da MATAHARI odpove turistični paket, ima potnik pravico do celotnega povračila vplačane cene aranžmaja, nima pa pravice do povračila stroškov vizuma ali stroškov cepljenj, ki so bili s programom zahtevani. O kakršnikoli naknadni spremembi programa MATAHARI potnika nemudoma obvesti.

V primeru, da stanje na kraju samem MATAHARI ne dopušča namestitve potnikov v naročenem objektu, lahko MATAHARI namesti potnika v istem kraju v drug objekt enake ali višje kategorije.

XII. ODGOVORNOST ORGANIZATORJA

MATAHARI odgovarja za izpolnitev pogodbe o paketnem potovanju ne glede na to, ali vključene potovalne storitve izvaja sama ali jih izvaja drugo podjetje.

Potnik brez nepotrebnega odlašanja, pri čemer se upoštevajo vse okoliščine primera, obvesti MATAHARI o vseh neskladnostih, ki jih ugotovi med izvedbo potovalnih storitev, vključenih v pogodbo o paketnem potovanju.

Če posamezna potovalna storitev ni izvedena v skladu s pogodbo o paketnem potovanju, MATAHARI odpravi neskladnosti, razen če:

  • to ni mogoče ali

  • to povzroča nesorazmerne stroške, pri čemer se upošteva obseg neskladnosti in vrednost potovalnih storitev, pri katerih se pojavijo neskladnosti s pogodbo.

Če MATAHARI v razumnem roku, ki ga določi potnik, ne odpravi neskladnosti, lahko potnik, razen v primerih iz prejšnjega odstavka, sam odpravi neskladnosti in zahteva povračilo nastalih stroškov. Potniku ni treba določiti razumnega roka za odpravo neskladnosti, če je neskladnost takšne narave, da jo je treba odpraviti takoj ali če MATAHARI neskladnosti noče odpraviti.

Če MATAHARI zaradi razlogov iz predprejšnjega odstavka ne odpravi neskladnosti, lahko potnik v skladu z določili XII. točke teh splošnih pogojev zahteva znižanje cene in povrnitev škode.

Kadar MATAHARI po začetku turističnega paketa ugotovi, da ne more zagotoviti znatnega dela potovalnih storitev, kot je dogovorjeno s pogodbo o paketnem potovanju, vključno s povratkom, potniku brez plačila dodatnih stroškov za nadaljnjo izvedbo turističnega paketa ponudi ustrezne nadomestne potovalne storitve, ki so po možnosti enake ali višje kakovosti od dogovorjenih.

Kadar je posledica predlaganih nadomestnih potovalnih storitev turistični paket nižje kakovosti, kot je naveden v pogodbi o paketnem potovanju, MATAHARI ustrezno zniža ceno turističnega paketa.

Potnik lahko predlagane nadomestne potovalne storitve zavrne le, če niso primerljive z navedenimi v pogodbi o paketnem potovanju ali če je znižanje cene neustrezno.

Če MATAHARI neskladnosti, ki znatno vplivajo na izvedbo turističnega paketa, ne odpravi v razumnem roku, ki ga določi potnik, lahko potnik odstopi od pogodbe o paketnem potovanju brez plačila odstopnine in v skladu z določili XIV. točke teh splošnih pogojev zahteva znižanje cene oziroma povrnitev škode, kadar je to ustrezno.

Če MATAHARI ne more zagotoviti ustreznih nadomestnih potovalnih storitev ali če potnik predlagane nadomestne storitve zavrne, ker niso primerljive z navedenimi v pogodbi o paketnem potovanju ali je znižanje cene neustrezno, lahko potnik, kadar je to ustrezno, v skladu s XIV. točko teh splošnih pogojev zahteva znižanje cene oziroma povrnitev škode, tudi če od pogodbe o paketnem potovanju ne odstopi.

Če je v turistični paket vključen tudi prevoz, MATAHARI v primerih iz prejšnjih dveh odstavkov brez nepotrebnega odlašanja in brez dodatnih stroškov za potnika zagotovi tudi povratek z enakovrednim prevoznim sredstvom.

Če zaradi neizogibnih in izrednih okoliščin ni mogoče zagotoviti povratka potnika, kot je dogovorjeno s pogodbo o paketnem potovanju, stroške potrebne nastanitve, ki je po možnosti enakovredne kategorije, kot je dogovorjena v pogodbi o paketnem potovanju, krije MATAHARI za največ tri nočitve. Če posebni predpisi Evropske unije, ki urejajo pravice potnikov, določajo daljše obdobje, ki velja za povratek potnika s temi prevoznimi sredstvi, se v primerih uporabe teh prevoznih sredstev uporabljajo daljša obdobja.

MATAHARI se ne sme sklicevati na neizogibne in izredne okoliščine pri omejevanju odgovornosti v skladu s prejšnjim odstavkom, če se zadevni prevoznik ne sme sklicevati na take okoliščine v skladu z zakonodajo Evropske unije.

Omejitev stroškov se ne uporablja za osebe z omejeno mobilnostjo, kot je določeno v točki (a) 2. člena Uredbe (ES) št. 1107/2006 Evropskega parlamenta in Sveta z dne 5. julija 2006 o pravicah invalidnih oseb in oseb z omejeno mobilnostjo v zračnem prevozu (UL L št. 204 z dne 26. 7. 2006, str. 1), vključno z osebami, ki jih spremljajo, za nosečnice in mladoletnike brez spremstva ter za osebe, ki potrebujejo posebno zdravstveno pomoč, če je bila MATAHARI vsaj 48 ur pred začetkom turističnega paketa obveščena o njihovih posebnih potrebah.

MATAHARI brez nepotrebnega odlašanja ponudi ustrezno pomoč potniku, ki se med potovanjem znajde v težavah, vključno s primeri iz prejšnjih treh odstavkov. Pomoč zajema zlasti:

  • zagotavljanje ustreznih informacij o zdravstvenih storitvah, lokalnih organih oblasti in konzularni pomoči;

  • pomoč pri zagotavljanju sredstev za komuniciranje na daljavo; in

  • pomoč pri iskanju nadomestnih potovalnih aranžmajev.

Če težave nastanejo zaradi namernega ali malomarnega ravnanja potnika, lahko MATAHARI potniku za pomoč, ki jo nudi v takem primeru, zaračuna razumno nadomestilo, ki pa ne sme presegati dejanskih stroškov.

MATAHARI ima za primer likvidnostnih težav organizatorja potovanja in podjetja, ki omogoča povezane potovalne aranžmaje, urejeno jamstvo z zavarovanjem pri zavarovalnici GENERALI d.d.


XII. PRAVICE POTNIKA

Potnik lahko za vsako obdobje, v katerem je obstajala neskladnost izvedenih potovalnih storitev s pogodbo o paketnem potovanju, zahteva sorazmerno znižanje cene, razen če MATAHARI dokaže, da je za neskladnost odgovoren potnik.

Potnik ima pravico, da mu MATAHARI brez nepotrebnega odlašanja povrne vsakršno škodo, ki mu je nastala zaradi kakršnekoli neskladnosti s pogodbo, razen če MATAHARI dokaže, da je:

  • za neskladnost odgovoren potnik;

  • za neskladnost odgovorna tretja oseba, ki ni povezana z zagotavljanjem potovalnih storitev, vključenih v pogodbo o paketnem potovanju, in je bila neskladnost nepredvidljiva ali neizogibna; ali

  • neskladnost posledica neizogibnih in izrednih okoliščin.

Višina denarne odškodnine za povzročeno škodo zaradi neskladnosti s pogodbo je omejena na višino trikratnega zneska celotne cene turističnega paketa, razen za povrnitev škode za telesne poškodbe ter za škodo, povzročeno namenoma ali iz malomarnosti.

Če mednarodne konvencije, ki zavezujejo Republiko Slovenijo, omejujejo obseg povračila škode ali pogoje, pod katerimi ponudnik posameznih potovalnih storitev, ki so del turističnega paketa, odgovarja za povrnitev škode, se za MATAHARI uporabljajo te omejitve.

Potnik lahko zahteva znižanje cene ali povrnitev škode zaradi neskladnosti s pogodbo o paketnem potovanju v dveh letih od nastanka neskladnosti.

Znižanje cene ali povrnitev škode zaradi neskladnosti s pogodbo o paketnem potovanju ne vpliva na pravice potnikov iz:

  • Uredbe (ES) št. 261/2004 Evropskega parlamenta in Sveta z dne 11. februarja 2004 o določitvi skupnih pravil glede odškodnine in pomoči potnikom v primerih zavrnitve vkrcanja, odpovedi ali velike zamude letov ter o razveljavitvi Uredbe (EGS) št. 295/91 (UL L št. 46 z dne 17. 2. 2004, str. 1), zadnjič popravljene s Popravkom (UL L št. 119 z dne 7. 5. 2019, str. 202);

  • Uredbe (ES) št. 1371/2007 Evropskega parlamenta in Sveta z dne 23. oktobra 2007 o pravicah in obveznostih potnikov v železniškem prometu (UL L št. 315 z dne 3. 12. 2007, str. 14), zadnjič popravljene s Popravkom (UL L št. 175 z dne 4. 7. 2015, str. 126);

  • Uredbe (ES) št. 392/2009 Evropskega parlamenta in Sveta z dne 23. aprila 2009 o odgovornosti prevoznikov potnikov po morju v primeru nesreč (UL L št. 131 z dne 28. 5. 2009, str. 24), zadnjič spremenjene z Uredbo (EU) 2019/1243 Evropskega parlamenta in Sveta z dne 20. junija 2019;

  • Uredbe (EU) št. 1177/2010 Evropskega parlamenta in Sveta z dne 24. novembra 2010 o pravicah potnikov med potovanjem po morju in celinskih plovnih poteh ter spremembi Uredbe (ES) št. 2006/2004 (UL L št. 334 z dne 17. 12. 2010, str. 1);

  • Uredbe (EU) št. 181/2011 Evropskega parlamenta in Sveta z dne 16. februarja 2011 o pravicah potnikov v avtobusnem prevozu in spremembi Uredbe (ES) št. 2006/2004 (UL L št. 55 z dne 28. 2. 2011, str. 1);

  • ter mednarodnih konvencij.

Potniki so upravičeni do vložitve zahtevka v skladu s temi splošnimi pogoji in navedenimi uredbami ter mednarodnimi konvencijami.

Povrnitev škode ali znižanja cen, ki jih potnik prejme na podlagi teh splošnih pogojev in uredb ter mednarodnih konvencij, se med seboj odštevajo, da se preprečijo prekomerna izplačila.

XIII. POTNI DOKUMENTI

Potnik mora imeti veljaven potni list ali drug veljaven dokument, s katerim lahko vstopi v državo, v katero ali skozi katero potuje.

Potnik je dolžan paziti na vsa določila glede veljavnosti potovalnega dokumenta. Veljavnost dokumenta se upošteva na zadnji dan potovanja. MATAHARI za morebitne neprijetnosti ali prisilno prekinitev potovanja potnika iz tega naslova ne odgovarja.

Potnik je dolžan pridobiti vizume, ki so za te države zahtevani. Če potnik te obveznosti ne izpolni, MATAHARI ravna po določilih o potnikovi odpovedi turističnega paketa. V primeru, da potniku MATAHARI ureja vizum, le-ta ne jamči za uspešnost pridobitve vizuma. Stroškov pridobitve vizumov MATAHARI potniku ne vrača. V primeru zavrnitve vstopa v državo ali drugih ovir nosi vse stroške potnik sam.

Smatra se, da si potnik ureja vizum sam, če MATAHARI ne dostavi vseh potrebnih dokumentov v predpisanem roku, ne glede na to, ali je potnik že vplačal pridobitev teh dokumentov.

Zaradi zahtev v mednarodnem potniškem prometu (letalski, ladijski, avtobusni itd.) je potnik dolžan ob prijavi posredovati vse potrebne podatke o vseh udeležencih potovanja, ki jih prijavlja. Podatki se morajo v celoti ujemati s podatki v uradnih dokumentih, ki so jih udeleženci potovanja dolžni v skladu s predpisi o prestopu državne meje in ustreznimi tujimi zakonodajnimi akti nositi s seboj.

V primeru, da napačni podatki povzročijo zamudo, dodatne stroške ali prekinitev potovanja drugim udeležencem, odgovarja za vse nastale stroške potnik sam.

Če potnik med potovanjem izgubi dokumente ali so mu le-ti ukradeni, in so nujno potrebni za nadaljevanje potovanja ali vrnitev v domovino, si potnik na lastne stroške priskrbi nove dokumente. V primeru, da mora potnik zaradi izgube ali kraje dokumentov prekiniti turistični paket, ni upravičen do kakršnegakoli povračila vplačanega turističnega paketa ali do povrnitve stroškov.

XIV. OBVESTILA

Potnik prejme končno obvestilo najkasneje 5 (pet) dni pred odhodom. Škodo, ki bi nastala, ker bi potnik podal nepopoln ali nepravilen naslov, nosi potnik.

V primeru, da potnik v navedenem roku ne prejme obvestila, se je dolžan sam javiti na svojem prijavnem mestu in ga zahtevati. Reklamacij iz naslova neprejete pošte MATAHARI ne upošteva.

XV. ZDRAVSTVENI PREDPISI

Potnik je dolžan opraviti cepljenja, ki so za državo potovanja zahtevana. V primeru, da so v programu za potovanje navedena oziroma zahtevana določena cepljenja, si mora vsak potnik sam priskrbeti mednarodno potrdilo – rumeno knjižico z vpisanimi opravljenimi cepljenji.

MATAHARI ne odgovarja za morebitne zaplete ali potnikovo prekinitev turističnega paketa zaradi potnikovega nespoštovanja zdravstvenih predpisov države, v katero vstopa, kakor tudi ne za stroške, povezane s tem.

XVI. CARINSKI PREDPISI

Potnik je dolžan spoštovati vse carinske in devizne predpise Republike Slovenije, kakor tudi predpise vseh drugih držav, v katere in skozi katere potuje. Če zaradi nespoštovanja predpisov potnik potovanja ne bi mogel nadaljevati, sam nosi vse posledice in stroške, ki nastanejo v zvezi s tem njemu in vsem drugim sopotnikom.


XVII. PRTLJAGA

MATAHARI ne odgovarja za prevoz, krajo ali poškodovanje potnikove prtljage ali drugih osebnih stvari, dragocenosti in dokumentov iz namestitvenih objektov (hotelskih sob, apartmajev ipd.) in prevoznih sredstev (letal, avtobusov, ladij ipd.). Prijavo izgubljene ali poškodovane prtljage potnik sam naslovi na prevoznika ali hotel.

Prevoz posebne prtljage (kot so kolo, surf, golf oprema, smuči, glasbeni inštrumenti ipd.) mora potnik najaviti že ob prijavi ter plačati prevozniku v skladu s pravili prevoznika, v kolikor v programu turističnega paketa ni drugače določeno. Vse stroške oziroma škodo, ki bi zaradi tega nastala, nosi potnik sam.

Pri prevozu ima potnik pravico do brezplačnega prevoza določene teže prtljage (po določilih prevoznika), vsak dodatni kilogram pa doplača potnik sam na kraju samem v ustrezni valuti oziroma po določilih prevoznika. Otroci do dveh let nimajo pravice do brezplačnega prevoza prtljage.

Pri nizkocenovnem prevozniku je dovoljena teža prtljage, ki jo potnik odda ob prijavi na let, običajno nižja od dovoljene pri rednih prevoznikih. Vsak dodatni kilogram se doplača. Tudi dovoljena teža osebne prtljage, ki jo vzame potnik s seboj na letalo, je lahko nižja, o čemer so potniki obveščeni najkasneje z obvestilom pred odhodom.

XVIII. INFORMACIJE

Informacije, ki jih potnik dobi na prijavnem mestu, ne obvezujejo MATAHARI bolj kot navedbe v programu ali ponudbi. V primeru dvoma se vedno šteje za veljavno pisna ponudba, račun in pogodba o potovanju, pisna informacija ali pisna razlaga.

XIX. REKLAMACIJE

Potnik je dolžan nepravilnosti sporočiti predstavniku MATAHARI na kraju samem, ko se zgodijo. V primeru, da bi bila reklamacija lahko rešena na kraju samem (na primer pomanjkljiva čistoča sobe, oprema, lega sobe ipd.), potnik pa ni sporočil napake oziroma nepravilnosti predstavniku agencije, se šteje, da se je potnik strinjal s tako storitvijo in s tem izgubil pravico do vlaganja kasnejših reklamacij.

Potnik lahko vloži pisno reklamacijo v roku dveh mesecev od dneva, ko je bila storitev nepravilno opravljena, sicer MATAHARI le-te vsebinsko ne obravnava. Reklamacija mora biti utemeljena. Potnik naj zato reklamaciji priloži ustrezne dokaze in/ali ustrezno potrdilo hotelirja, prevoznika oziroma druge ustrezne osebe o dejanskem stanju, na podlagi katerega potnik uveljavlja svoj zahtevek.

MATAHARI je dolžna pisno odgovoriti na reklamacijo v 8 dneh po njenem prejemu. Če gre za enostavno pomanjkljivost in napaka ni sporna (oziroma če potnik ni priložil vseh potrebnih dokumentov v roku, potrebnem za njihovo pridobitev), je MATAHARI dolžna po prejemu popolnega reklamacijskega zahtevka zahtevi ugoditi. Če napaka ni enostavna, je MATAHARI dolžna raziskati vse okoliščine, ki so pripeljale do reklamacije. Dokler MATAHARI ne odloči o pritožbi, se potnik odreče posredovanju katerekoli druge osebe, sodnih ustanov ali dajanja informacij javnim glasilom.

Ne glede na vloženo reklamacijo je potnik dolžan poravnati svoje obveznosti po izdanih računih za opravljeno storitev v skladu z razporedom plačil; morebitna odškodnina pa se izplača po končanem reklamacijskem postopku na osebni račun potnika.


XIX. DRUGA DOLOČILA


Organizator osebam, ki se s spodaj navedenimi pogoji udeležbe ne strinjajo, ni dolžan vrniti denarja.

  1. Udeleženec v celotiUdeleženec v celoti odgovarja za vsa dejanja, ki jih izvrši tekom dogodka, in posledice teh dejanj. Odgovarja ne glede na to, ali se dejanja zgodijo na jadrnici ali zunaj nje. Udeleženec nosi tudi morebitne stroške, ki nastanejo zaradi njegovih ravnanj.

  2. V primeru nastanka kakršnekoli materialne škode, jo je odgovorni udeleženec dolžan poravnati sam. 

  3. Organizator ni odgovoren za morebitne poškodbe, bolezni, zdravstvene težave, smrt ali škodo, nastalo tekom dogodka. Z udeležbo na dogodku udeleženec nase prevzema odgovornost za tovrstna tveganja. Udeleženec nase prevzema tudi tveganje in stroške iskanja in reševanja.

  4. Organizator si pridržuje pravico do spremembe poti plovbe, zamude ali popolne odpovedi dela dogodka ali dogodka v celoti zaradi slabega vremena ali višje sile. Udeleženec v takem primeru ni upravičen do vračila denarja. 

  5. Organizator ne odgovarja za škodo, ki udeležencu nastane na njegovi osebni lastnini. Vsak udeleženec sam skrbi za svoje osebne predmete.

  6. Udeleženec mora spoštovati navodila, ki jih tekom dogodka sporoči organizator. V primeru neupoštevanja navodil, organizator udeleženca odstrani z dogodka na njegove stroške. Udeleženec v takem primeru ni upravičen do vračila denarja.

  7. Uživanje prepovedanih substanc je na dogodku strogo prepovedano. Organizator ni odgovoren za kakršnekoli prepovedane snovi, najdene na plovilu ali zunaj njega. Organizator ne odgovarja za posledice uporabe alkohola in prepovedanih substanc. V primeru nespoštovanja te točke, sledi postopek iz točke 6 te izjave.

  8. Organizator lahko po lastni presoji uporabi storitve zunanjih izvajalcev. Za njihovo ravnanje ne odgovarja.

  9. Organizator sme fotografije in videoposnetke, na katerih je udeleženec, uporabiti v promocijske in tržne namene. Če udeleženec ne želi biti vključen v fotografiranje in/ali snemanje, mora o tem ustno obvestiti organizatorja. Organizator je na fotografijah in videoposnetkih dolžan varovati dostojanstvo udeleženca.

  10. Udeleženec je dolžan spoštovati ostale udeležence dogodka. Nasilje, spolno nadlegovanje in druga moteča ravnanja so strogo prepovedana. V primeru nespoštovanja te točke, sledi postopek iz točke 6 te izjave.


XX. VARSTVO PODATKOV

MATAHARI vse pridobljene podatke o potnikih varuje v skladu z Zakonom o varstvu osebnih podatkov. MATAHARI vse pridobljene podatke o potnikih obdeluje skladno s Politiko varstva osebnih podatkov, dostopno na www.mataharinautics.com

XXI. KONČNE DOLOČBE

MATAHARI ne priznava nobenega izvajalca izvensodnega reševanja potrošniških sporov kot pristojnega za reševanje morebitnega spora glede potnikovih zahtevkov v zvezi s potovanjem. V primeru spora med strankami se uporabi pristojno sodišče.
